1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Prova ("we", "our", "us"). By accessing or using our BS7858 security vetting platform at useprova.co.uk (the "Service"), you agree to be bound by these Terms.

If you are using the Service on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not use our Service.

2. Our Services

Prova provides a BS7858-compliant security vetting platform that enables:

  • Employers to commission pre-employment screening for candidates
  • Candidates to complete vetting applications digitally
  • Verification of identity, employment history, education, and qualifications
  • Criminal record checks (DBS) and financial probity checks
  • Generation of audit-ready vetting reports and certificates

Our services are designed to comply with BS7858:2019 standards for security screening of personnel in security environments.

3. User Accounts

3.1 Account Registration

To use our Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Account Security

You must:

  • Use a strong, unique password
  • Not share your login credentials with others
  • Notify us immediately of any unauthorised access
  • Keep your contact information up to date

3.3 Account Types

We offer two account types:

  • Employer Accounts: For organisations commissioning vetting checks
  • Candidate Accounts: For individuals completing vetting applications

4. Employer Terms

4.1 Employer Responsibilities

As an employer using our Service, you agree to:

  • Only commission vetting for legitimate employment purposes
  • Obtain appropriate consent from candidates before initiating checks
  • Handle vetting results in accordance with data protection law
  • Not discriminate unlawfully based on vetting results
  • Maintain confidentiality of vetting reports
  • Comply with the Rehabilitation of Offenders Act 1974 and related legislation

4.2 Use of Vetting Results

Vetting reports are provided for your internal hiring decisions only. You must not:

  • Share reports with third parties without consent
  • Use reports for purposes other than employment screening
  • Make copies beyond what is necessary for your records

5. Candidate Terms

5.1 Candidate Responsibilities

As a candidate using our Service, you agree to:

  • Provide accurate, truthful, and complete information
  • Not omit relevant information that may affect your vetting
  • Respond promptly to requests for clarification or documentation
  • Provide valid consent where required (DBS, credit checks, references)

5.2 Accuracy of Information

You confirm that all information provided is true and complete to the best of your knowledge. Providing false or misleading information may result in:

  • Rejection of your vetting application
  • Withdrawal of any offer of employment
  • Dismissal if already employed
  • Potential legal action

5.3 Consent

By using our Service, you consent to us:

  • Contacting your previous employers for references
  • Verifying your identity through official documents
  • Conducting checks you have specifically consented to
  • Sharing results with your prospective employer

6. Payments and Pricing

6.1 Pricing

Our current pricing is:

  • Standard Vetting: £79 per candidate (14-day completion)
  • Priority Vetting: £149 per candidate (5-day completion)

All prices are in GBP and inclusive of VAT where applicable.

6.2 Payment Terms

Payment is required before vetting commences. We accept major credit/debit cards through our secure payment provider (Stripe).

6.3 Refunds

Refunds may be available in the following circumstances:

  • Application cancelled before vetting work begins: Full refund
  • Candidate withdraws during vetting: Partial refund at our discretion
  • Service failure on our part: Full or partial refund

No refund is available once vetting is complete, regardless of the outcome.

7. Service Levels

7.1 Completion Times

We aim to complete vetting within:

  • Standard: 14 calendar days
  • Priority: 5 calendar days

These timeframes assume prompt candidate cooperation and timely responses from third parties (employers, referees, verification bodies). Delays caused by external factors are not within our control.

7.2 Platform Availability

We aim to maintain 99.9% platform uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible.

8. Intellectual Property

All content, software, and materials on our platform are owned by or licensed to Prova. You may not:

  • Copy, modify, or distribute our software or content
  • Reverse engineer or attempt to extract source code
  • Use our branding without written permission
  • Scrape or harvest data from our platform

9. Limitation of Liability

9.1 Service Limitations

While we strive for accuracy, we cannot guarantee:

  • Complete accuracy of third-party information (references, credit data)
  • Detection of all discrepancies or fraud
  • Specific outcomes of vetting checks

9.2 Liability Cap

To the maximum extent permitted by law, our total liability for any claims arising from or related to the Service shall not exceed the fees paid by you in the 12 months preceding the claim.

9.3 Exclusions

We shall not be liable for:

  • Indirect, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Decisions made based on vetting results
  • Actions of third parties (referees, verification bodies)

10. Termination

10.1 By You

You may close your account at any time by contacting us. This does not affect vetting cases already in progress or completed.

10.2 By Us

We may suspend or terminate your account if you:

  • Breach these Terms
  • Provide false information
  • Use the Service for unlawful purposes
  • Fail to pay fees when due

10.3 Effect of Termination

Upon termination, your access to the platform ceases. Data retention continues as required by law and our Privacy Policy.

11. Disputes and Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating legal proceedings, you agree to attempt to resolve disputes through good-faith negotiation by contacting us at legal@useprova.co.uk.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
